Terms of Use

Magyar változat

These terms apply when you use the PODivo app and its related pages (together: “PODivo”). You accept them when you create an account, and when you place an order as a guest at an event. If you do not agree, please do not use PODivo.

2. What PODivo is

PODivo helps a group that shares a stock of coffee capsules — an office, a family, a café — to see what is in stock and to place and fulfil coffee orders within the group. A group is called a HUB.

An order in PODivo is a request from one member of a HUB to the people who manage that HUB. PODivo does not sell, deliver or serve coffee, capsules or machines, and is not a party to any arrangement between the members of a HUB.

3. Your account

You need an account to use PODivo, except when you order as a guest at an event. Please give accurate information, keep your sign-in details safe, and do not share your account. You are responsible for what happens under your account.

You must be old enough to enter into a contract in your country, or use PODivo with the consent of a parent or guardian.

You can delete your account at any time in the app (Profile → Profile settings), or request deletion without the app at podivo.app/support/#delete-account. What happens to your data is described in the Privacy notice.

4. HUBs and roles

The person who creates a HUB is its owner. The owner and the co-admins they appoint manage the HUB: its members, its stock and its orders. They decide who may join, they can remove a member from the HUB, and they are responsible for how their HUB is used.

What you write in an order (for example a note or a name) is visible to the people who manage that HUB.

5. Licence and intellectual property

We grant you a personal, non-exclusive, non-transferable, revocable licence to use PODivo in line with these terms. PODivo, its software, design and content (other than your content and other companies’ trademarks) belong to us or our licensors. Nothing in these terms transfers any of these rights to you.

6. Plans

PODivo has a free plan (Free) and two paid plans (Barista and Office). The features and limits of each plan — for example the number of HUBs, co-admins and people — are shown in the app on the Subscription screen before you buy. A plan belongs to an account and covers the HUBs that account owns; a member may also subscribe on behalf of a HUB they belong to.

7. Subscriptions, trials and payments

Paid plans are auto-renewing monthly subscriptions that you buy in the app through the Apple App Store or Google Play. The price is shown before you confirm the purchase.

Payment and renewal. Payment is charged to your store account when you confirm the purchase. The subscription renews automatically for the same period and price until you cancel it. On the App Store, cancel at least 24 hours before the end of the current period to avoid being charged for the next one; on Google Play, you can cancel at any time before the renewal date.

Managing and cancelling. You manage and cancel your subscription in your App Store or Google Play account settings; the Subscription screen has a link to them. Deleting your PODivo account or removing the app does not cancel a store subscription.

Free trial. Where a free trial is offered, it is available once per user. Unless you cancel before the trial ends, it converts into a paid subscription to the plan you chose, at the price shown when you started it.

Changing plans. You can switch between plans and Office seat sizes in the app. How and when the change and its price take effect follows the rules of the store you bought from.

When a subscription ends. Your account returns to the Free plan. Your HUBs, stock and order history are kept, but the features and limits of the Free plan apply, and some settings that only exist on a paid plan may be removed.

Event tickets. An event ticket is a one-time purchase that lets a HUB start one additional 24-hour event. It belongs to the HUB it was bought for and is used up when the event starts. An unused ticket does not expire; it cannot be moved to another HUB or exchanged for money.

Refunds. Purchases are processed by Apple or Google, and refund requests are handled by them under their own policies. If you are a consumer, any right of withdrawal or refund that the law of your country gives you remains unaffected.

Price changes. If the price of a subscription changes, you will be informed in advance through the store, as its rules require.

8. Acceptable use

Please use PODivo lawfully and considerately. We have zero tolerance for objectionable content and abusive users. Objectionable content includes harassment, threats, hate speech, sexual or violent content, content that infringes other people’s rights, and any illegal content.

You also may not try to access accounts, HUBs or data that are not yours; disrupt, overload or probe the service; copy, resell or reverse engineer it; or access it by automated means.

9. Your content, reports and moderation

The content you add (such as order notes, names and suggestions) remains yours. You allow us to store and display it to the extent needed to run PODivo for you and your HUB. PODivo has no public content: what you write is only shown to the people who manage the HUB it was sent to.

Reporting. You can report content or a user in the app (Profile → Feedback) or without the app at podivo.app/support/#report. Please say which HUB it concerns, what the content is and why you consider it objectionable or illegal. We review reports within 24 hours.

What we do. We may remove content that breaks these terms or the law, and suspend or remove the user responsible. The people who manage a HUB can remove a member from their HUB and reject orders at any time.

Our decisions. If we remove your content or restrict your account, we will tell you what we did and why, unless the law prevents us. You can contest our decision through the Support page, and we will review it again. If you reported something, we will tell you what we decided.

10. Brewing guides

The brewing guides in the app are AI-generated and are provided for information only. They are not instructions from the manufacturer of your machine or capsules. Always follow the manual and the safety instructions of your own equipment.

To create a guide, the details of the order — the coffee, the cup size, the chosen options, the machine model set for the HUB and the note written on the order — are sent to our AI provider. Your name, email address and account are not sent. Please do not put personal information in an order note.

11. Other companies’ products and names

PODivo is an independent app. It is not endorsed or sponsored by, or affiliated with, the manufacturers of the capsules and machines it lists. Product, line and machine names are trademarks of their respective owners and appear only to identify the products users have in stock.

12. Availability and changes to the service

We work to keep PODivo available and reliable, but we do not promise that it will always be available or free of errors. We may change, add or remove features, and we may carry out maintenance.

If we plan a change that is to your disadvantage in more than a minor way — for example one that significantly reduces what a paid plan offers — we will tell you in the app in reasonable time before it takes effect. In that case you may end your contract free of charge within 30 days of the notice or of the change, whichever is later, by cancelling your subscription and deleting your account.

13. Liability

PODivo is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, for arrangements between the members of a HUB, or for coffee, ingredients or equipment that are prepared, supplied or used by the members of a HUB. If you add your own ingredients or requests to an order, you do so at your own risk.

Nothing in these terms limits or excludes our liability for damage caused intentionally or by gross negligence, for harm to life, body or health, or any other liability that cannot be limited by law. Your rights as a consumer are not affected.

14. Suspension and termination

You may stop using PODivo and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms; where reasonable, we will warn you first, and we will tell you the reason as described in section 9.

15. Changes to these terms

We may update these terms, for example when the service or the law changes. We will publish the new version on this page. If a change is significant or to your disadvantage, we will tell you in the app at least 30 days before it takes effect. If you do not agree with it, you may end your contract free of charge before it takes effect, by cancelling your subscription and deleting your account.

16. Complaints and disputes

If you have a complaint, please send it to us through the Support page or by email to tolnai.gergely@gmail.com. We reply in writing within 30 days.

If you are a consumer and we do not resolve your complaint, you may turn to a conciliation board (in Hungary: the békéltető testület for the place where you live or stay; elsewhere in the European Union: the consumer dispute resolution body of your country). The procedure is free of charge. You may also go to court.

17. Apple App Store

If you downloaded PODivo from the Apple App Store: (a) these terms are between you and us, not Apple, and we, not Apple, are solely responsible for PODivo and its content; (b) your licence is limited to using PODivo on Apple-branded products you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions (including Family Sharing where applicable); (c) Apple has no obligation to provide maintenance or support for PODivo; (d) if PODivo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation; (e) we, not Apple, are responsible for any claims relating to PODivo, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection claims; (f) we, not Apple, are responsible for any third-party claim that PODivo infringes intellectual property rights; (g) you confirm that you are not located in a country that is subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties; (h) you must comply with the third-party terms that apply when you use PODivo (for example your mobile data agreement); (i) Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

18. Governing law

These terms are governed by the laws of Hungary. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of that country.
